It is also true that no human being is perfect including the most reputed professional in different fields leave alone medical. Many doctors have fallen prey to this human weakness that exists in all of us. Therefore, any error in judgment amounts to negligence. A doctor is liable for prosecution  if a plaintiff is capable of proving that the doctors is guilty did something that another qualified doctor with ordinary skills would not have done in reasonable action. Many doctors have found themselves on the wrong side of the law for small mistakes such as misdiagnosis of simpler infections. Such mistakes are regarded criminal, as easily detectable illnesses are not easily misdiagnosed.

Warranty of perfection is one-thing doctors will not guarantee (Beauchamp and Childress, 2001, p. 45). However, a doctor should be given enough room to exercise his or her skills. If a doctor administers the best he or she can in accordance to the practice and in the best interest of the patient, then the doctor can not be held accountable in case of any eventualities. This has enabled the doctors to execute their services to the people with the right procedures and without fear. This has however not gone down with many doctors and other practitioners, as an error factor due to imperfection is always probable.
